The Calcutta High Court has upheld a stay on the arrest warrant issued by the Sessions Judge, Alipore against Indian cricketer Mohammad Shami in a domestic violence case.

After considering the presented facts carefully, the Court determined that the issuance of an arrest warrant against Shami, rather than a summon, was in violation of the rule of law.

The pacer’s wife Hasin Jahan had filed a case of cruelty and assault against the cricketer in 2018. As per the allegations by Jahan, Shami had assaulted her after she protested against the cricketer’s alleged extra-marital affairs. She also accused Shami of being unfaithful and maintaining relations with multiple women.

Jahan had filed a written complaint against Shami with the Jadavpur police station under Section 498A and Section 354 of the Indian Penal Code in March, 2028. Then a charge sheet was filed against Shami. The Chief Judicial Magistrate of Alipore then issued arrest warrants against the Team India pacer and his relatives on August 29, 2019.

Subsequently, Shami and his relatives had filed a revision against the order before the Sessions Judge of Alipore. A stay on the arrest warrant against Shami was granted on September 9, 2019.
