New York: US prosecutors will ask a judge to dismiss all charges against former IMF boss Dominique Strauss- Kahn in a sexual abuse case since they cannot prove "beyond a reasonable doubt" the charges filed against him by a Guinean hotel maid, a media report said today.

Prosecutors would file "a `Dismissal On Recommendation` motion," which will say the indictment against the former IMF chief "cannot be proven beyond a reasonable doubt because of credibility problems" with Nafissatou Diallo, who accused Strauss-Kahn of sexually abusing her in a Manhattan hotel, The New York Post reported.

The motion would be "lengthy, thorough and carefully crafted," the report said, adding the Manhattan District Attorney`s Office will ask the judge to dismiss all charges against Strauss-Kahn at the next court hearing scheduled on August 23.

The motion will lay out facts of the case, including a procedural chronology and details of District Attorney Cyrus Vance`s "labour-intensive, four-month investigation into the strength -- and failings -- of the evidence."

The Post said the dismissal motion will also include "never-before-revealed" details that will question the credibility of the 32-year-old maid.

Prosecutors have said Diallo previously lied to authorities about being raped in her native Guinea and on her application seeking asylum in the US.

These doubts over her credibility have dented the prosecution`s case against Strauss-Kahn, who has denied any wrongdoing.

The motion will ask Manhattan Supreme Court Justice Michael Obus, who has handled the matter since Strauss-Kahn`s arraignment, to dismiss the indictment, the report said.

The New York Post report said judges mostly grant such motions immediately, which means Strauss-Kahn could be free to fly back to France.

"When it is the DA asking for dismissal, it is never denied," defense lawyer Michael Shapiro was quoted as saying in the Post report. "I suppose a judge technically could deny it but then no one would show up to prosecute the case on the next court date."

Diallo has been invited by prosecutors for a meeting on Monday to explain "to her what...will occur in court on the following day."

she has also filed a civil suit against Strauss-Kahn seeking unspecified monetary damages.

Kenneth Thompson, the lawyer for Diallo, said he received a two-paragraph letter from Vance`s office saying the prosecutors would "like to invite" the maid for a meeting to explain "to her what I anticipate will occur in court on the following day."

Thompson said the letter is an indication that prosecutors would seek to have a judge "dismiss all or some of the charges" at the court hearing in the case on Tuesday.

"My interpretation of that letter is that they are going to announce that they are dismissing the case entirely, or some of the charges," the New York Times quoted Thompson as saying.

Thompson said the prosecutors would not have asked to meet with his client unless they intended to dismiss the charges.

"If they were not going to dismiss the charges, there would be no need to meet with her. They would just go to court the next day to say, `We`re going to proceed with the case.`"

Thompson added he and his client were eager to attend the meeting to find out the reasons behind the prosecution`s decision, the report added.

In the letter, assistant district attorney Artie McConnell said, "Should she (Diallo) not be available or should she fail to attend, I will assume that she does not wish to take advantage of this opportunity."

Thompson said: "the tone of the letter is consistent with the unfair way the Manhattan district attorney?s office has treated Diallo throughout this process. It is as if she is the defendant and Dominique Strauss-Kahn is the victim."

A law enforcement official has said Diallo`s credibility was further dented by a telephone conversation she had with a man in an immigration detention center in Arizona a day after she said she had been sexually attacked by Strauss-Kahn at a Manhattan hotel.

During the conversations, Diallo spoke of possibly exploiting Strauss-Kahn?s wealth, the report said.

Thompson has also filed a civil lawsuit on Diallo`s behalf against Strauss-Kahn seeking unspecified monetary damages.
