New Delhi: The Supreme Court on Monday deferred its hearing on Justice Shah Commission's report on illegal mining till February 10.
Adjudging Centre’s refusal to place the probe panel’s report on illegal mining in Odisha and Jharkhand before the apex court, it also asked the Center to file another affidavit in this regard.
In the earlier hearing the Centre had argued that the Commission’s report have to be first looked into by Parliament.
It had said placing the reports before the court would "impinge" upon the jurisdiction of Parliament and pre-empt the statutory provisions.
Sources said the hearing would be taken up in the apex court on February 10 and continue till February 17.
On January 13, a green bench of SC headed by Justice A K Patnaik had directed the Centre to place the report on illegal mining in Odisha and Jharkhand before it by January 27.
The bench had passed the order after advocate Prashant Bhushan, appearing for petitioners, alleged that contents of the reports, published in newspapers, are shocking and the apex court should analyse them.
The bench was also supposed to hear the plea of the petitioner Goa Foundation seeking its direction to the Centre to extend the time period of Shah Commission of Inquiry by one year to enable the commission to complete its inquiry and submit reports on mining-related issues in accordance with its terms of reference.
