Justice Kumari Sanju Panda said the ongoing recruitment process will continue as per the December 2011 advertisement, where there was no mention of the Teachers Eligibility Test (TET).
The verdict, to bring relief to around 20,000 aspirants, made it clear if the state wished to conduct an eligibility test for these teachers, it could do so only after completion of the ongoing recruitment process.
"The essential eligibility criterion for Sikhya Sahayaks shall be conducted for these teachers at later date," the judge said.
The state last year had invited applications from eligible persons for recruitment of Sikhya Sahayaks.
Accordingly, over one lakh aspirants applied for the same and the respective district authorities prepared a merit list of the applicants on the basis of their career markings.
However in April this year, when the recruitment process had made significant progress, the state government decided to conduct TET for these aspirants stating that the test was essential for the primary school teachers as per the norms of National Council for Teachers Education.
This decision of the government was, however, challenged in the high court by several aspirants and accordingly, the court had earlier stayed the proposed TET that was scheduled for July 5 this year.
At least a dozen petitions were filed in the HC stating that the government had arbitrarily taken a decision regarding the TET while there was no mention of the same in the advertisement.
