But the petitioner Susanta Mallick and his wife have refused to accept the baby girl claiming that a baby boy was born to them which was swapped by the hospital staff, the government affidavit said. The Division Bench of Chief Justice V Gopala Gowda and Justice S K Mishra however, allowing the contention of the petitioner directed that the parents who also had a baby boy born to them in the hospital around 5.10 pm on the same day should also be made parties in the case.
Meanwhile, Nirupama Mallick, wife of Sukanata Mallick ? whose whereabouts are not being provided by the hospital authorities, has gone home with the baby boy. Asking Nirupama and Sukanta to place their views in the matter, the Bench asked the High Court registry to issue notices to them for an appearance in the court on April 26 and adjourned the case till that day.
Meanwhile, the high court also directed the authorities to discharge Rashmita from the hospital. Hospital authorities were not allowing Rashmita to leave the hospital without the baby girl, for which her husband had urged the high court to interfere.
