In an ambitious move to clear the mounting backlog of court cases in Odisha, the state government has introduced a new Standard Operating Procedure (SOP) for Public Prosecutors (PPs) and Additional Public Prosecutors (APPs) in criminal cases.
This initiative aims to reduce unnecessary adjournments and expedite judicial proceedings that have remained stuck in the system for years.
As per data presented in the Odisha Assembly in March, nearly 20,87 347 cases are pending in various courts, including the High Court. Acknowledging that frequent adjournments requested by lawyers and the absence of witnesses and investigating officials are among the key reasons for delays, the government has decided to put the brakes on this long-running trend.
Key Provisions of the New SOP
The Home Department’s newly issued SOP outlines strict measures that prosecutors must take to avoid unnecessary adjournment requests, especially when witnesses are present.
Only two adjournments will be allowed per case for any reason, and further delays will be discouraged.
Citing engagements in other courts will no longer be an acceptable excuse for delaying hearings.
If the witness is present but the defence is unprepared, the court may proceed with recording statements and cross-examination.
In cases where delay is caused without valid reasons, financial penalties may be imposed on either the prosecution or the defence side.

Apart from these, prosecutors will now be required to submit monthly reports detailing case progress, number of adjournments, reasons for delays and compliance with court directives.
This reporting mechanism is designed to ensure accountability and transparency in case management.
"Justice delayed is justice denied. Judicial proceedings must be expedited. Discussion has been made between the Home, Law and GA Departments before the SOP was issued," said Law Minister Prithviraj Harichandan.
Training and Monitoring Mechanisms
To ensure proper implementation, all PPs and APPs will undergo training and awareness sessions regarding the new SOP. The Director of Public Prosecutions (DPP) will periodically review adherence and assess the SOP’s effectiveness to prevent violations and maintain momentum.
Legal experts and advocates have welcomed the initiative, stating that the SOP could play a critical role in delivering speedy and effective justice. According to them, if implemented stringently, this could mark a turning point in tackling Odisha’s colossal case backlog and restoring faith in the legal system.
"It has been found that verdicts are getting delayed due to unnecessary adjournments. There should be objections about the adjournments of defence councils if they have not been taken on genuine grounds. The SOPs have been issued for the speed disposal of cases in the courts," said senior lawyer Soura Chandra Mohapatra.
