Odisha Govt allows part sale of plots sans approval

Odisha govt's new amendment allows part sale of plots up to 500 sqm without approval, easing land transactions for owners and developers. However, the sold plots cannot be used for real estate purposes. This relaxation also applies to land with multiple co-owners, where plots of 500 square meters can be sold.

The Odisha government introduced on Tuesday the ODA (Planning & Building Standard) Second Amendment Rules, allowing part sale of plots and without approval for patches of land up to 500 square meters in size, bringing relief to landowners and developers.

Sold plots cannot be used for real estate purposes

As per the new rules, landowners can now sell plots of up to 500 square meters without requiring approval. However, the sold plots cannot be used for real estate purposes. This relaxation also applies to land with multiple co-owners, where plots of 500 square meters can be sold. The move aims to boost land transactions and development in the State.

A draft of the Odisha Development Authorities (ODA) (Planning and Building Standards) Second Amendment Rules, 2025 was earlier published as required under section 125 of the Odisha Development Authorities Act, 1982 (Odisha Act 14 of 1982) in the Extraordinary Issue of the Odisha Gazette No.-721, dated 25th March, 2025 under the Notification of the Government of Odisha in the Housing and Urban Development Department No.-6899-HUD-TP-POLICY-0003/2020/HUD., dated the 25th March, 2025 inviting objection and suggestion from all persons likely to be affected thereby, till the expiry of a period of 15 days from the date of publication of the said Notification in the Odisha Gazette.

Objections and suggestions were received in respect of the said draft before the expiry of the period so specified, has been duly considered by the State government.

“In exercise of the powers conferred by Section 123 of the said Act and in supersession of the Odisha Development Authorities (Planning and Building Standards) Amendment Rules, 2022, the State Government do hereby make the following rules to further amend the Odisha Development Authorities (Planning & Building Standards) Rules, 2020,” a notification issued by Urban and Housing Development department mentioned.
