"We will not allow you (Tiwari`s counsel) to frustrate the order. Let`s not allow the impression to gather momentum that you can flout the court orders in this manner," Justice Gita Mittal said, asking the counsel to produce medical records of the 85-year-old leader on July 11.
Unless there were some medical reasons because of which he is not giving blood samples, Tiwari cannot be allowed to act in this manner, the court said.
"Mark my words, for every wrong submissions, a cost would be imposed on you and I am not going to adjourn this case. Your application would be heard only after you give your blood sample," Justice Mittal said.
The court was hearing two applications of Rohit Shekhar, seeking prosecution of Tiwari for non-compliance of the high court order, duly endorsed by the Supreme Court, asking him to give his blood sample to ascertain the man`s claim of being his biological son.
"The issue of conduct of DNA test can be decided later but first of all you provide the blood sample before the crucial evidence vanishes," the court said.
Rohit had yesterday moved the court for initiation of contempt proceedings against Tiwari after he steadfastly refused to give his blood sample for the DNA test.
Tiwari, who has been a former chief minister, union minister and governor, has been defying the court order contending that "nobody can be pressurized to give evidence in this manner."
