Bhubaneswar/Jaipur/New Delhi: Despite being granted bail by the Supreme Court on March 31, Bitihotra alias Bitti Mohanty, son of former Odisha top cop BB Mohanty, convicted of raping a German fellow student, received a jolt after Jaipur central jail authorities refused to release him. The refusal came in the wake of SC granting him bail only in the rape case and not the parole jump matter.

Earlier, the Jaipur fast track court had ordered that Mohanty would have to spend three months more in jail for jumping parole even after spending seven years rigorous imprisonment in the case.

Meanwhile, Mohanty's lawyer has decided to move Rajasthan High Court challenging the refusal of Jaipur jail authorities.

"Now since the Supreme Court has granted leave in the matter, there will be a considerable amount of time when the matter will be listed. Under section 482 of CrPc, we will file an application in Rajasthan High Court apprising it of the SC decision. Therefore, the HC can exercise its vested powers and release the accused on bail in parole jump case also. Otherwise, it would be a violation of SC order", Bitti's lawyer Sarthak Nayak said.

Mohanty, who had been sentenced seven years rigorous imprisonment by Jaipur fast track court, had absconded in 2006 after getting parole on the ground of visiting his ailing mother. After seven years on the run, he was rearrested in March 2013 by Kerala police from Kannur where he was working in a bank on a fake identity.

Bitti was convicted in March 2006 for raping a 26-year-old foreign national in a hotel in Alwar, Rajasthan.
