Odisha notifies Apartment Ownership and Management Ordinance
The Odisha government on Saturday notified the Odisha Apartment (Ownership and Management ) Ordinance, 2023. The Law department on Saturday issued a gazette notification marking the enforcement of the ordinance.
As per the notification, the ordinance will be applicable to all apartments or buildings converted into apartments irrespective of whether their construction was before or after the date of the enforcement of the Ordinance.
Similarly, the Ordinance will also be applicable to all apartments used or proposed to be used for residence, office, practice of any profession, or carrying on any occupation, trade, or business or for any other type of use.
However, the ordinance will not be applicable to a building used for the purpose of holding office or otherwise of a department of the government or of a government undertaking or where the building is owned and used by the owner himself or letting it out to others.
The ordinance also makes it clear that the promoters and the allottees are responsible to form an association of the allottees if either 50 % of allottees or seven allottees, which is lower, have been allotted apartments.
For the formation of the association, an application shall be submitted to the competent authority in such forms and in such manner as may be prescribed for the registration of the association within six months from the date of the enforcement of the Ordinance.
