The IIC (Inspector In Charge) of Mahanga Police Station, Nihar Ranjan Mohanty submitted the reinvestigation report of the sensational double murder case involving BJP leader Kulamani Baral and his associate, and the Call Detail Report (CDR) of the three accused in the JMFC court on Friday, as directed earlier.
As per reports, Mohanty had been buying time from the court to submit the reports prompting the court to issue a show-cause notice, seeking explanation by December 10 as to why coercive and punitive action shall not be taken against him as per CrPC for not appearing before it.
The court had also sought an explanation from him over repeatedly buying time for filing reinvestigation report and call detail record (CDR) of three accused in the case.
The court had earlier rejected a time petition filed by the police officer and issued the show cause notice under Section 171 of the Indian Evidence Act and 311 of CrPC. In its 9-page order, the court also expected the cop to furnish the reinvestigation report and up-to-date CDR by December 10 apart from submitting a reply to the show-cause notice.
Speaking to the reporters, defence lawyer, Prabin Kanungo said, “The rule of law finally prevailed today. After dodging the order for more than three months, the IIC finally deposed before the JMFC court.”
“As per his deposition, Mohanty has received the CDR from the SP on December 6, 2021. He also has received the Service Provider’s certificate with regards to the CDR which the Court had sought,” Kanungo said.
“Not only that, but as per the Court’s order, Mohanty has also submitted statements of 10 witnesses before the Court,” he added.
It is pertinent to mention here that the JMFC court had ordered a fresh probe into the brutal murder of BJP leader Kulamani Baral and his associate Dibyasingha Baral on January 2 this year after Ramakanta Baral, the son of the slain BJP leader had moved the court challenging the dropping of the name of Minister Pratap Jena from the charge sheet.
