The Police Inspector who led the escort team which was shifting the gangster Hyder to Baripada Circle Jail from Choudwar Circle Jail on Friday, lodged a first information report (FIR) at the Simulia Police Station in Balasore district enumerating details of the encounter of the criminal.
Giving titbit details of Hyder's encounter, the complainant Gangadhar Saseni, a Police Inspector at Cuttack UPD, said that after receiving orders from the Cuttack Judicial Magistrate First Class (JMFC) Court on July 24, he, along with SI Asit Ranjan Jena, H/M Gajendra Nath Soren and Havildars Surya Kumar Rout, Soumya Ranjan Rout, Satyajit Swain, Rohit Kumar Mallick, Purusottam Rout, Rajendra Nayak and Kalpataru Nayak reached the Choudwar Circle Jail at 11.55 am where they received the convict, SK Hyder Ali, and left for Baripada Circle Jail at 12.40 pm.

“Since he was a dreaded criminal and previously had escaped from the SCBMCH while undergoing treatment, we hand cuffed the convict as a precautionary measure to guard against any attempt to escape,” stated Saseni in the FIR.
“While we were travelling near Simulia at around 3.20 pm, Hyder asked me to stop the vehicle to attend nature’s call. Though I, along with my staff, asked the driver not to stop the vehicle from his (Hyder’s) security point of view, but Hyder became stubborn and said that he was suffering from acute diabetes. So he had to attend the call of nature,” the FIR read.
We stopped the vehicle at a diversion point near a Hanuman Temple at Simulia. Hyder requested to unlock his hand cuffs as he had to attend nature’s call and wash his hands. As soon as the escort Havildar unlocked one side of the hand cuff, he immediately snatched away an AK-47 from Havildar Surya Kumar Rout and ran to a distance, added the FIR.
Pointing gun towards the escort party, Hyder started hurling abuses at them in Hindi, the FIR stated.
Though Saseni and SI Asit Ranjan Jena warned him to surrender before the police, he refused and was desperate to open fire at the escort party, the FIR stated.
“In such a dangerous situation of life and death and in exercise of the right to private defence, and to save the life of police personnel from imminent danger of death, Asit Jena fired three rounds from his service pistol to prevent any attack. He took all precautions to resort to controlled fire to hit in the lower part of the body below the waist of the convict with a view to immobilize him and to prevent him from opening fire, which endangered the lives of all police personnel,” Saseni mentioned in the FIR.
Seseni further mentioned that if the escort would not have resorted to firing, Hyder would have killed the escort party members from the AK-47 gun that he stanched away from Havildar Surya Kumar Rout.
Though the escort team immediately shifted a bullet-ridden Hyder to Balasore District Headquarters Hospital (DHH), he died while undergoing treatment, Saseni mentioned in the FIR.
