According to sources, the charge-sheet has been prepared under Sections 376 (A), 376 (B), 302, 363 of Indian Penal Code (IPC) and Section 6 of the POCSO Act.
The Salepur minor girl rape case is the first in Odisha after the Union Cabinet had cleared an ordinance last month to amend the POCSO Act awarding death penalty to those convicted of raping a child up to 12 years of age.

The six-year-old girl from Salepur was rescued from a school campus near her house with deep injuries on her head, face, neck, chest and private parts on April 21. The girl was immediately rushed to a hospital in Salepur and later shifted to the SCB Medical College and Hospital where she breathed her last on April 29.
One Md Mustafa from the same village was arrested by the police for raping the girl.
According to the survey conducted by LocalCircles, 18 per cent voted for life imprisonment without parole for convicted rapists while three per cent said it should be a seven-year jail term (which is the current law).
To catch the citizens' pulse on the Protection of Children from Sexual Offences (POCSO) Act, LocalCircles conducted six nation-wide polls which received more than 40,000 votes.
In the second poll, 89 per cent agreed that they want their states to pass a law that awards death penalty within six months. Madhya Pradesh, Rajasthan, Haryana and Arunachal Pradesh have also passed a law that awards death penalty for child rape.
In another poll, which was about engaging more women officers to register cases of sexual assault, it was found that 78 per cent citizens were in support of every district level police station to have at least one woman officer.
For the fourth poll, on maximum time taken by the police to file a charge sheet in cases of child rape, only 28 per cent said it should be done within 30 days, while 25 per cent said 45 days.
In the fifth poll, it was found that 65 per cent want POCSO judges to only handle cases which are related to child sexual abuse.
The final poll on the maximum time taken for justice in cases of child rape under POCSO act, 85 per cent citizens said it should be within six months.
The incident came to light Wednesday after a case under Protection Of Children From Sexual Offences (POCSO) act was registered against the accused at Nizamuddin police station in south Delhi earlier this week.
The case was registered a few hours after the victim, who studies in the first standard, informed her family members about the incident.
The accused, whose name can not be revealed in order to protect the victim's identity, has been arrested and sent to judicial custody.
The girl informed her parents that she was sexually assaulted by the accused several times inside the canteen of her school.
Now the bill, would be send to the Lok Sabha for its approval.
The Protection of Children from Sexual Offences (Amendment) Bill, 2019 also provides for fines and imprisonment to curb child pornography.
It was introduced in the Rajya Sabha on Tuesday by Women and Child Development Minister Smriti Irani.
Earlier this month, the Union Cabinet approved amendments to strengthen the POCSO Act to combat rising cases of child sex abuse.

The proposed amendment provides for stringent punishment including death penalty for sexual assault on minors.
O'brien said that the more people speak about the sexual abuse and share their experience with family members there are possibilities of its prevention. He appealed for taking all measures to prevent the heinous crime against child.
"I would like and urge more people especially in public life, if you have been sexually abused or harassed as a child, please come up and speak about it," the TMP legislator said.
The Protection of Children from Sexual Offences (Amendment) Bill, 2019 provides for stringent punishment including life imprisonment for using child for pornographic purposes.
The new law is expected to discourage the trend of child sexual abuse by acting as a deterrent due to strong penal provisions in the Act. It intends to protect the interest of vulnerable children in times of distress and ensures their safety and dignity.
There has been a rise in crime against children in the country in recent years. It is estimated that 1.6 lakh cases of child abuse are pending in states in 31 states and union territories (UTs).
As per official data, about 12,609 rape cases were registered under the POSCO this year.
Birla's ruling came during the discussion on the Protection of Children from Sexual Offences (POCSO) Act, as a member of the treasury benches asked an opposition member to sit and not speak.
Without naming the member, Birla said: "Who ordered you to tell that member to sit? ... if any member passes such comments, he will have to stand and apologise for his act in the House from next time."
He reiterated that there is no need to pass comments on any member while sitting on their seats.
