Cuttack: In an interim order, the Orissa High Court today restricted the Odisha Electricity Regulatory Commission (OERC) from taking any decision without the leave of the Court with regard to power tariff hike on the basis of ongoing annual hearing on tariff hike proposals.

This order from the High Court came while adjudicating over a PIL filed by Keonjhar Nabanirman Parishad represented by its secretary advocate Dilip Mohapatra.

Mohapatra in his petition had alleged that the regulatory commission is holding the hearings at places not notified earlier with a motive to deny the public from attending the hearings.

A Division Bench of the High Court comprising Justice Kumari Sanju Panda and Justice Raghuvir Dash in an interim order said "any decision taken by the opposite party (OERC) on the hearing of objections shall be subject to the final outcome of the writ petition."

The High Court also directed the OERC to file its counter to the petition before the next hearing of the matter scheduled on February 26.

Mohapatra in his petition has maintained that the OERC, shifting from its previous practices is holding the hearings at places which were never notified earlier. Apart from Bhubaneswar, he said the hearings were recently held at Rourkela and Baripada and there are plans to hold further hearings at Puri and Koraput.
