Cuttack: The Orissa High Court on Monday began hearing of the alleged custodial rape of a 21-year-old tribal girl by police and CRPF personnel and issued notice to the state government to file an affidavit within a week.

Her father Daksha Majhi, who has alleged that his daughter was gangraped by CRPF and state police personnel in custody after she was arrested on charge of being a Maoist almost three years ago.

Seeking to quash a lower court order that rejected his plea to direct the police to register the gang rape incident and investigate into it, the petitioner has approached the high court seeking CBI enquiry into the whole incident and for damages of Rs 10 lakh from the state government.

When the matter came up for hearing before the single- judge bench of Justice B K Nayak on the day, the government counsel sought at least two weeks time to file the affidavit.

The High Court however, granted one week to him.

The petitioner, a native of Jadingi village of Gajapati district, has alleged that his 21-year-old daughter was dragged from his house on the night of February 12, 2010.

Personnel from the CRPF and SOG (special operation group) raped her on way to police station and implicated her in false cases branding her as a Maoist, the petition alleged.

Then woman she has been lodged in Berhampur jail as an under trial prisoner.
