Bhubaneswar: The State cabinet on Wednesday approved the proposal of the Revenue and Disaster Management Department for amending Section 22-A of the Registration Act, 1908 thus mandating prior permission of the competent authority during transactions of the immovable properties in categories as being opposed to Public Policy.

The properties for which patta production or competent authority’s permission will henceforth be mandated during registration are - properties of the State Government of local authorities, properties belonging to any religious institutions to which the Odisha Hindu Religious Endowment Act, 1951 is applicable and properties recorded in the name of Lord Jagannath Mahaprabhu, Puri.
 

Besides, properties donated for Bhoodan Yagna and vested in the Odisha Bhoodan Yagna Samiti established under Section 3 of the Odisha Bhoodan and Gramdan Act, 1970 are also included in the category.

This apart, properties belonging to Wakfs which are under the superintendence of the Odisha Wakf Board established under the Wakf Act, 1995 also fall under this category.

The new amendment also empowers the registering officer not to register any document unless the transferor produces the record of rights that such transferor has right, title and interest over the property.
