Highlighting a case of an 'extreme situation' related to the appointment of dental surgeons, the Orissa High Court on Wednesday directed the Odisha Public Service Commission (OPSC) to take a fresh decision.
As per a report by The New Indian Express, the High Court's directions came after facts pointing at an ‘extreme situation’ were found in the affidavit filed by the OPSC’s.
The report quoted the directive in which the OPSC was asked by the division bench of Chief Justice Chakradhari Sharan Singh and Justice Savitri Ratho to "take a different decision as to what it proposes to do in light of the admitted fact to the effect that persons of lower merit are working as dental surgeons based on the recommendations of the commission whereas persons with higher score have not been recommended”.
The High Court has fixed September 11 as the date for the final hearing on the matter.
As per the affidavit filed by the OPSC secretary, Satyabrata Ray, for the appointment of dental surgeons in Group-A (Junior) of Odisha Medical Services (Dental) cadre posts in 2018-19, two recommendations were made - one being the pre-revised cut-off mark & the other was a revised cut-off list based on an expert committee report.
The New Indian Express report quoted Ray's admission in the affidavit as “Due to this, some of the candidates, whose names are not within the revised cut-off marks, are working as dental surgeon basing on earlier recommendation made by the commission.”
According to the report, "The affidavit also cited that 43 candidates, who have secured more marks in post revision than the last candidate of the pre-revised merit list, had not been recommended."
The revised select list based on the expert committee report excluded 11 candidates earlier recommended by the OPSC.
As per the report the OPSC secretary further stated in his affidavit that “Consequent upon the revision of marks, eight candidates whose names were not found in the earlier select list, have found place in the revised select list. Accordingly, the commission intimated their names to the Health and Family Welfare department on November 4, 2022, for appointment.”
