In a big relief to Barabati-Cuttack MLA Mohammed Moquim, the Supreme Court has stayed the Orissa High Court’s order nullifying his election to the Odisha Legislative Assembly in 2019.
While hearing a petition filed by BJD leader Debashish Samantaray, the Orissa High Court on March 4, 2024, annulled the election of the Congress leader for allegedly failing to furnish detailed information regarding criminal cases against him in an affidavit during the filing of nomination in 2019.
Besides seeking direction to declare his election null and void, the petitioner had also sought direction to the Election Commission to conduct fresh polls. The petition further cited that Moquim did not disclose correct facts about his assets and liabilities.

The Orissa High Court’s ruling had effectively made Cuttack-Barabati Assembly Constituency vacant until the next election.
However, the Supreme Court’s order on Monday has come as a huge relief for the legislator.
At a time when the 2024 General Elections are just around the corner, it seems things are going well for the Barabati-Cuttack MLA as his suspension from the Congress party was withdrawn in January and now the country’s apex court has stayed the HC order.
