Gurgaon-resident Suresh Kumar was let off with the fine after he was convicted for intentionally insulting the magistrate presiding over a traffic court.
Kumar had reached the court of the magistrate concerned at Saket court complex for disposal of his challan on September 1, 2011 at 3.36 PM. He was asked to come the next day as it was too late. At this, Kumar lost his cool and insulted the presiding judge by passing derogatory remarks against him.
A complaint was made to Additional Chief Metropolitan Magistrate Mukesh Kumar by the traffic court staff following which a notice was served on the man. Kumar, however, pleaded guilty and apologised for his act and assured the court that he would never repeat the mistake.
Showing a lenient approach towards Kumar who could have been sent to six-month jail under Section 228 of IPC, the court let him off with the fine and the period already spent in custody.
Section 228 of IPC provides maximum punishment of six- month jail or a fine of Rs 1,000 or both for insulting a public servant sitting in any stage of a judicial proceeding. "Considering his submissions and the fact that accused has pleaded his guilt at a very initial stage, he is sentenced for the period already undergone and fine of Rs 1,000," the judge said.
